This Privacy Policy describes how All Season Digital, LLC, doing business as Luv Film Co ("Luv Film Co," "we," "us," or "our"), collects, uses, and discloses personal information about visitors to luvfilm.co (the "Site") and customers of our products and services. By using the Site or our services, you consent to the practices described in this Privacy Policy.

This Privacy Policy is part of, and should be read together with, our Terms & Conditions, Rental Agreement, Refund & Cancellation Policy, and Shipping & Delivery Policy.

2. Information We Collect

Information you provide

We collect personal information you voluntarily provide when you:

Place an order

Submit an inquiry (including international rental inquiries)

This may include your name, email address, phone number, mailing address, event details, destination country (for international inquiries), and payment information.

Payment information is processed by third-party payment processors and is not stored by Luv Film Co.

When you use the Site, we and our service providers automatically collect certain information, including:

Footage you submit

When you return rental equipment, we receive video footage captured by you and your guests. This footage may include images and audio of identifiable individuals. We use this footage to provide the editing services you have purchased, for quality control and operational purposes, and for the marketing purposes described in Section 4 below and in Section 24 of the Rental Agreement.

3. How We Use Your Information

We use your information to:

Process bookings, payments, and refunds

Ship equipment to you and confirm its return

Process international rental inquiries and coordinate international shipping and customs

Deliver edited films and raw footage to you

Communicate with you about your order, including delivery updates and customer service

Send you marketing communications, where permitted by law and subject to your right to opt out

Operate, maintain, and improve the Site and our services

Detect, prevent, and respond to fraud, abuse, security threats, and violations of our Terms

Comply with applicable law and respond to lawful requests

4. Use of Footage in Marketing

By submitting video footage to Luv Film Co as part of our editing services, you grant Luv Film Co the marketing license described in Section 24 of the Rental Agreement. You may opt out of this use by emailing hello@luvfilm.co before the start of the rental period. We will not identify you, your guests, or your event by name in marketing materials without your prior written consent.

5. How We Share Your Information

We share your information with:

Service providers who perform services on our behalf, including payment processors, shipping carriers (including international carriers and customs brokers), video editors, cloud storage providers, marketing platforms, and analytics providers

Advertising and analytics partners, including Meta Platforms, Inc. and Google LLC, for the purposes of measuring and optimizing our advertising campaigns

Customs and government authorities, when required to process international shipments

Legal and regulatory authorities, where required by applicable law or in response to valid legal process

Successors in interest, in connection with a merger, acquisition, or sale of all or substantially all of our assets

We do not sell your personal information for monetary consideration.

6. Cookies and Tracking Technologies

We use cookies and similar tracking technologies to operate the Site, remember your preferences, measure performance, and deliver targeted advertising. You can control cookies through your browser settings. Disabling cookies may affect the functionality of the Site.

7. Data Retention

We retain personal information for as long as necessary to provide our services, comply with legal obligations, resolve disputes, and enforce our agreements. Raw footage and edited films are retained for a minimum of ninety (90) days after delivery to allow for redelivery requests, after which they may be deleted from active storage, as described in Section 8 of the Rental Agreement.

8. International Data Transfers

Luv Film Co is based in the United States, and your personal information is stored and processed in the United States. If you are located outside the United States, including in the European Economic Area (EEA), United Kingdom, Switzerland, Canada, Australia, or any other jurisdiction with data protection laws, you acknowledge that your personal information will be transferred to and processed in the United States, which may have data protection laws different from those of your country.

By using our services or submitting an international rental inquiry, you consent to this transfer.

9. Your Privacy Rights

Depending on your jurisdiction, you may have the right to:

Request access to the personal information we hold about you

Request correction of inaccurate personal information

Request deletion of your personal information

Opt out of marketing communications

Opt out of the sale or sharing of personal information for cross-context behavioral advertising (California residents under the CCPA/CPRA)

Object to or restrict certain processing of your personal information (residents of the EEA, UK, and similar jurisdictions)

10. California Privacy Rights (CCPA/CPRA)

If you are a California resident, you have additional rights under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (collectively, "CCPA"). These include the right to know what personal information we collect, the right to request deletion, the right to correct inaccurate information, the right to opt out of the sale or sharing of personal information, and the right not to be discriminated against for exercising these rights. We do not sell personal information for monetary consideration but we do share certain information with advertising partners for cross-context behavioral advertising. If you are located in the European Economic Area, the United Kingdom, or Switzerland, the General Data Protection Regulation (GDPR) and equivalent national laws give you the rights described in Section 9, plus the right to lodge a complaint with your local data protection supervisory authority.
